Terms of Service – Accelerator Library

Accelerator Library is a product of Sandra L Leyva Inc.  These Terms of Service ("Terms") govern your access to and use of the Accelerator Library ("Program"). Please read these Terms carefully, and contact us if you have any questions. By accessing or using our Program, you agree to be bound by these Terms.

License

As a purchaser of this program, you may use one copy of the program materials in print or digital format for your personal use only.  Once you have completed using the printed or digital copy, you must dispose of it.  You agree and shall NOT share or give the program materials to anyone else. 

 

Access to the program materials may be granted by providing you with a login URL, user name, and password. You agree that you will not reveal these login details to any other person and will take reasonable steps to ensure that your personnel do not reveal their login details to any other person.

Intellectual Property

All materials in the program are copyright Sandra L. Leyva, Inc.  All rights are reserved.  It is against the law to make copies of this material without securing written permission in advance from Sandra L. Leyva, Inc.  No part of program materials may be reproduced, stored in retrieval systems, or transmitted in any form or by any means – including but not limited to electronic, mechanical, photocopying, and recording – beyond the license agreement without prior written permission from Sandra L. Leyva, Inc.

You agree and will NOT remove any copyright or other similar notices on the materials.

Delivery

All program materials are delivered by webinar and digitally.  All notifications are delivered by email.  It is your responsibility to contact us if you are not receiving email or have not received access to the program materials.  If you unsubscribe from our email list, you understand we will be unable to deliver your materials and keep you notified of features of the program and you agree we have no responsibility to do so. 

CPE Certificates

CPE Certificates are self-serve.  Members who desire CPE must generate their own certificate(s) at AccountantsAccelerator.com.  Please also keep a paper copy for your records. 

Your Responsibilities

As a program member, you understand and agree that you are fully responsible for your physical, mental and emotional well-being during the program sessions, including your choices and decisions. 

 

You understand that the coaching and mastermind portions of this program are comprehensive processes that may involve all areas of your life, including work, finances, health, relationships, education and recreation.  You acknowledge that deciding how to handle these issues, incorporate the program materials into those areas, and implement your choices is exclusively your responsibility.

 

You understand that this program does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association.  You understand that this program is not a substitute for counseling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment and you will not use it in place of any form of diagnosis, treatment or therapy.  You promise that if you are currently in therapy or otherwise under the care of a mental health professional, that you have consulted with the mental health care provider regarding the advisability of working with this program and that this person is aware of your decision to proceed with this program.

 

Your information will be held as confidential unless you state otherwise, in writing, except as required by law.  You understand that certain topics may be anonymously and hypothetically shared with other professionals for training OR consultation purposes.

 

You understand that this program is not to be used as a substitute for professional advice by legal, medical, financial, business, spiritual or other qualified professionals.  You will seek independent professional guidance for legal, medical, financial, business, spiritual or other matters.  You understand that all decisions in these areas are exclusively yours and you acknowledge that your decisions and your actions regarding them are your sole responsibility.

 

Confidentiality of Fellow Members

We respect your privacy and must insist that you respect the privacy of fellow program members.  You agree not to violate the privacy rights of any program member.   We respect your confidential and proprietary information ideas, plans, and trade secrets and must insist that you respect the same rights of fellow program members and of Sandra L. Leyva, Inc.  You agree not to infringe any program member’s or Sandra L. Leyva Inc.’s trademark, copyright, patent, trade secret, or other intellectual property rights.  You agree that any confidential information shared by program members or any representative of Sandra L. Leyva, Inc. is confidential and proprietary, and belongs solely and exclusively to the member who discloses it or to Sandra L. Leyva, Inc.  You agree not to disclose such information to any other person or use it in any manner other than in discussion with program members during program sessions.   

 

Posting Content

Accelerator Library allows you to post content, including discussions, questions, photos, comments, and other materials. Anything that you post or otherwise make available on our Accelerator Library is referred to as "User Content." You retain all rights in, and are solely responsible for, the User Content you post to Accelerator Library.

 

You grant Accelerator Library and its members a non-exclusive, royalty-free, transferable license to use and store your User Content on Accelerator Library solely for the purposes of using the Accelerator Library program. Nothing in these Terms shall restrict other legal rights Accelerator Library may have to User Content, for example under other licenses. We reserve the right to remove or modify User Content for any reason, including User Content that we believe violates these Terms or our policies.

Customer Service

You agree that Accelerator Library is very economically priced, and for that reason you understand that it is very much a self-service program.  Limited support is available by email at support@sandismith.com.  You are welcome to call, and if you do, please do not be insulted if we ask you to send us an email.

If you feel like you might need a higher level of service, please ask to set up a time with Sandi who can suggest putting you in a product that is more customized to your personal service needs. 

Payment

Members will receive access to the program materials upon their initial payment.    

Termination

The terms of this agreement begin on the date you purchase the Accelerator Library and are in force as long as you are using the program materials.  Access to the program materials ends on December 31 of the year of purchase. You will be given the option to renew prior to that expiration date.  Sandra L. Leyva, Inc. may terminate or suspend your participation at any time, with or without cause or notice to you. Upon termination, you continue to be bound by the License, Intellectual Property, No Warranties, and Payment sections of these Terms.

Refund

There are no refunds.

Applicable Laws

You agree to comply with all applicable laws in relation to your participation and your use of the materials. You further agree not to share specific prices or pricing details, or any other information that would violate the Federal Trade Commission laws, even if you are not a U.S. resident, during any of the Accelerator Library discussions, webinars, chats, emails, or other program activity with any of the other Accelerator Library members.  

No Warranties

We disclaim all warranties, express or implied, with respect to the goods or services provided hereunder, including implied warranties of merchantability and fitness for a particular purpose.  You acknowledge that we have not made and you are not relying upon any representations or promises of performance except those expressly set forth in these terms. 

Indemnification

You agree to indemnify and hold us harmless from and against any and all claims, including but not limited to, negligence, negligent misrepresentation, or breach of contract, made by third parties based in whole or in part on a claim that such party was damaged as a result of any act by you or us related in any way to the program materials.

No Manufacturers Warranties

During the course of the engagement, we may recommend a purchase and installation of computer or technological hardware, software, communications, or services by your company.  Warranties, to the extent they exist, are provided only by the manufacturer/vendor of those computer products.  We specifically disclaim all warranties, express or implied, including the implied warranty of merchantability and fitness for a particular purpose, regarding the functionality or capability of the computer products installed by you, any third party vendor, or us as part of this engagement.

Security

We care about the security of our users. While we work to protect the security of your content and account, Sandra L. Leyva, Inc. cannot guarantee that unauthorized third parties will not be able to defeat our security measures. Please notify us immediately of any compromise or unauthorized use of your account.

 

 

 

Governing Law and Jurisdiction This Agreement shall be governed by and construed in accordance with the laws of the State of Texas (without regard to conflict of law principles).
